THE NATIONAL ENGAGEMENT ON THE PROPOSED AMENDMENTS OF MERCHANT SHIPPING (LIABILITY AND COMPENSATION FOR OIL AND BUNKER OIL POLLUTION) ACT 1994 (ACT 515) AND ITS REGULATIONS

On 17 June 2025, the Maritime Institute of Malaysia (MIMA), in collaboration with the Malaysia Marine Department (MMD), organised a session on the National Engagement on the Merchant Shipping (Liability and Compensation for Oil and Bunker Oil Pollution) Act 1994 (Act 515) and the Regulations Thereof. The session took place at the Auditorium of MMD Headquarters and brought together stakeholders from relevant ministries, maritime agencies, academia, legal experts, and the private sector, to discuss Malaysia’s legislative alignment with international maritime conventions.
 
The event began with welcoming remarks by YBhg. Dato’ Mohamed Suffian Awang, Chairman of MIMA, and an opening speech by YBrs. Tuan Norjipin Bin Saidi, Director of BKSAS, MMD, who also delivered the closing remarks. Two key presentations were delivered during the sessions: Mr. Mohd Tarmizi Osman, Assistant Director of MMD’s Safety, Security and Environment Division, briefed on Act 515 and related international conventions (IOPC Funds, CLC and BCC), followed by Ts. Egbert Adolf Naintin from MIMA’s Centre for Ocean Law and Policy (OLAP), who shared the proposed amendments to Act 515. After the presentations, a Mentimeter session was held to gather live feedback and perspectives from participants, allowing for interactive and inclusive engagement.
 
Participants engaged actively in the Q&A segments, providing useful insights and suggestions for improving the existing legal framework. The session successfully achieved its objective of fostering greater understanding and collaboration in enhancing Malaysia’s maritime liability and compensation regime. MIMA remains committed to supporting legal reforms and promoting good maritime governance through multi-stakeholder engagement.
